What is a Victim Impact Statement?
A Victim Impact Statement is a written or oral statement presented to the court at the sentencing of the defendant.
You are entitled to make a statement that will be included in the probation officer’s presentence report. This statement is not about what can or cannot be proven. It is an opportunity for you to tell the Court about how the crime has affected you and those that you love.
You can also include your opinions on sentencing and any probation restrictions that may be placed on the defendant.
How to write a Victim Impact Statement?
You can think about the following questions:
- How has the crime affected your well-being or the well-being of people close to you?
- Have you or people close to you sought counsel?
- Have your personal or work relationships changed as a result of the crime?
- Did you have physical injuries or symptoms due to the crime?
- How has the crime affected your ability to work, attend school, make a living, run a household, enjoy activities, or feel safe?
- What changes have you had to make?

Your statement will not be confidential. The probation report will be made available to the defendant and to any member of the public for 60 days after the sentencing hearing.
